November 20, 2025 | The Toy Association™ is directly engaging in New Mexico’s rulemaking process for SB 212 (aka the PFAS Protection Act) to make sure the toy industry’s interests are represented as the state moves to regulate products with intentionally added per- and polyfluoroalkyl substances (PFAS). As currently drafted, the rules would require PFAS-specific labeling on toys and other products beginning January 1, 2027, and would prohibit their sale entirely by January 1, 2032, unless an exemption applies.
The Association is closely reviewing the proposed framework, which raises several concerns regarding timing, labeling requirements, and reporting obligations. Association staff will also meet directly with regulators to advocate for practical, science-based solutions, including reasonable compliance timelines and appropriate exemptions for certain toy components.
To support the development of the industry’s formal comments during the upcoming public comment period, companies are strongly encouraged to share their feedback with The Toy Association by the end of this month. Members may also indicate if they are interested in participating in in-person meetings in New Mexico (dates to be announced) and are asked to provide any toy-specific examples that could be affected by the proposed requirements.
